The dunes of Is Arenas, located in the town of Narberth (Sardinia), among the last left in Europe, could be swept away by the construction of a tourist village and a golf course.
If the tourist facility in question were indeed made, we will back to scarring of a natural treasure of the Mediterranean - also cataloged by the European Commission as "Site of Community Importance" (Sic) - with the consequent risk of losing rare species animals and flowers that characterize the dunes and beach of Is Arenas. The questioner
is aware of the fact that the Commission has referred the matter to the Court of Justice in order to denounce Italy for infringement of Directive 92/43/EEC (1) on the conservation of flora and fauna.
1. Does the Commission if there are other cases of defacement of sites of Community importance in Italy brought before the European Court of Justice?
2. Considers it appropriate to create a special European corps, the direct dependence of the Commission, whose purpose is to monitor the zone "Sic" and protect it from irreparable damage caused by irresponsible human activity?

Over the years the Commission has addressed the problem of failure by the Italian authorities of Directive 79/409/EEC on the conservation of wild birds (the "Birds Directive") (1) and Directive 92 / 43/CEE on the conservation of natural habitats and of wild fauna and flora (the "Habitats Directive") (2) initiating a number of procedures infringement, which in some cases, have resulted in actions before the European Court of Justice (ECJ).

Both cases relate to projects located within Natura 2000 sites that had been authorized by the Italian authorities in breach of Community law concerning the protection of nature. The related cases under Article 228 of the EC Treaty are still ongoing and will be brought forward to the full and complete enforcement of judgments of the Court.
The EC Treaty requires the Commission to the role of "Guardian of the Treaty" and as such the Commission launches infringement proceedings against Member States where, among other things, is ignorant of the need to avoid disfigurement of Natura 2000 (compulsory prescribed by the Directives listed above). However, under European legislation on nature protection, as well as in all other areas of Community law, it is primarily the responsibility of Member States to ensure the correct application of the law, which in this case involves the monitoring of the conservation status of species and habitats protected and the duty to provide an adequate level of protection of SCI.
those circumstances, it is currently envisaged the establishment of a special body under the responsibility of the European Commission with the task of monitoring the SCI in Europe and protect them against damage from human activities.
